ARBITRATION

ARBITRATION RULES AND GOVERNING LAW
Arbitration shall take place San Francisco, California, using California law. The arbitration will be administered by the American Arbitration Association ("AAA") in accordance with the Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes (the "AAA Rules") then in effect, except as provided in these Terms of Service (the AAA Rules are available at www.adr.org/arb_med or by calling the AAA at 1-800-778-7879). The Federal Arbitration Act will govern the interpretation and enforcement of this Section. WAIVERS The failure of Nesting Days to exercise or enforce any provision of these Terms of Service shall not constitute a waiver of such right or provision, of any other provision or of Nesting Days’ right to require strict observance of each remaining term. If any provision or section of these Terms of Service is found to be unenforceable or invalid for any reason, that provision or section shall be severable, and all other provisions shall remain in full force and effect.
